Commercial Terms Governing All Trade Transactions
These Terms & Conditions govern the commercial relationship between BuilderMaterials.in (the 'Platform' and 'Seller') and all trade buyers ('Purchaser' or 'Buyer') who engage with our platform for the purpose of sourcing, ordering, or purchasing construction materials and related products. These terms apply to all transactions conducted through BuilderMaterials.in unless superseded by a separate written agreement explicitly signed by authorised representatives of both parties. Submitting an order or purchase inquiry constitutes acceptance of these Terms & Conditions in full.
1. Ordering and Minimum Order Quantity (MOQ)
All orders placed through BuilderMaterials.in must comply with the applicable Minimum Order Quantity (MOQ) for the selected product and category. MOQ requirements are stated in product documentation and quotations, and vary based on product category, material type, and customization requirements. Orders failing to meet the applicable MOQ may be rejected, subject to a small-quantity surcharge, or deferred until combined with other orders to meet threshold requirements. Customised MOQs for established repeat buyers or combined multi-product orders may be negotiated through separate written supply agreements.
2. Pricing, Quotations, and Payment
All prices are stated in formal quotations issued by BuilderMaterials.in and are exclusive of applicable GST, customs duties, and freight charges unless explicitly stated otherwise. Quotation prices are valid for the period specified in the quotation document. After the validity period, prices are subject to revision based on raw material costs, production availability, and market conditions. New buyers are required to provide advance payment or a deposit as specified in the quotation before dispatch of goods commences.
3. Delivery, Dispatch, and Risk Transfer
Goods are dispatched within the lead times confirmed in the sales documentation. Risk of loss or damage to goods transfers to the Buyer upon handover to the nominated carrier at our dispatch point, unless a separate delivery arrangement is explicitly agreed in writing. For export orders, risk transfer and responsibility allocation follow the Incoterm specified in the export sales contract. Buyers are responsible for all import duties, destination-country taxes, customs clearance costs, and local delivery charges unless otherwise agreed.
4. Inspection, Claims, and Returns
Buyers are required to inspect all received goods within 48 hours of delivery and must report any claim — including transit damage, short-supply, or quality non-conformity — within seven calendar days of delivery. Claims must be submitted with supporting photographic evidence, the order number, batch identifiers, and a written description of the issue. Following claim verification, BuilderMaterials.in will propose a fair resolution: replacement material for proven manufacturing defects, partial credit for minor discrepancies, or full refund for batches confirmed as unusable.
5. Limitation of Liability
BuilderMaterials.in's total liability for any claim arising from a transaction is strictly limited to the invoice value of the affected goods. We are not liable for indirect, consequential, incidental, or special damages including lost profits, project delays, business interruption, or reputational harm, except where mandated by applicable Indian law. Buyers indemnify BuilderMaterials.in against claims arising from product misuse, improper handling, unauthorized modifications, or use in applications for which the material is not specified or certified.
6. Governing Law and Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of India. All disputes arising from transactions on BuilderMaterials.in are subject to the exclusive jurisdiction of the courts of Delhi, India, unless an alternate forum is explicitly agreed in a signed bilateral agreement. Parties are encouraged to first attempt amicable resolution through mutual negotiation, and if unsuccessful, through formal mediation before initiating litigation proceedings
